ARTICLE 2 - SUBJECT
This section outlines the fundamental features of the products or services subject to this contract. The information within this preliminary information form is provided in good faith and for commercial purposes, ensuring protection for minors and individuals lacking full legal capacity.
The consumer agrees and undertakes to be solely responsible for payment made under this Agreement, including any cases where payment is made using a third party’s credit card or other payment methods, and the third party refuses payment.
ARTICLE 3 - PRODUCTS SUBJECT TO CONTRACT
The type, quantity, brand/model, colour, price, and delivery information of the products are listed below.
ARTICLE 4 - GENERAL TERMS
4.1. The BUYER confirms that they have read the preliminary information about the product's essential qualities, total sale price including taxes, payment method, delivery process and costs, which are the responsibility of the BUYER, the estimated delivery period, and the SELLER’s full commercial title, address, and contact details on www.heyniri.co The BUYER declares they understand all terms and have provided electronic confirmation. By confirming this order form, the BUYER enters into a payment obligation. A copy of the contract will be sent to the registered email address after the contract is concluded.
The contract will be stored in our data system for six months, and a copy can be provided by email upon request within this period.
4.2. The product will be delivered within the timeframe indicated on the website, not exceeding the legally mandated 30-day period, depending on the BUYER’s location. This period may be extended by a maximum of 10 days, with prior written notice to the Consumer.
4.3. If the product is to be delivered to a person/entity other than the BUYER, the BUYER must specify this in the Preliminary Information Form. The SELLER will not be held responsible if the designated person/entity refuses delivery.
4.4. In the event that the carrier company cannot deliver the product to the BUYER due to any issues during transit, the BUYER accepts that the SELLER bears no responsibility.
4.5. The SELLER is responsible for ensuring that the product is delivered intact, complete, as specified in the order, and with any applicable warranty certificates and user guides.
4.6. The SELLER may, for justifiable reasons, provide a product of equal quality and price to the BUYER before the fulfilment obligation period expires.
4.7. If fulfilment of the service or delivery of the product becomes impossible, the SELLER will inform the Consumer before the fulfilment obligation expires and may refund the amount paid to the BUYER.
4.8. If the product payment is not made for any reason or is cancelled in bank records, the SELLER is considered released from their delivery obligation.
4.9. If the BUYER's credit card is used unauthorizedly by others, due to reasons not caused by the BUYER, and the bank or financial institution does not pay the SELLER, the BUYER must return the product within three days after receiving it, at their own expense.
4.10. If the SELLER is unable to deliver the product on time due to force majeure or extraordinary circumstances, such as adverse weather conditions or disruptions in transportation, the SELLER will notify the BUYER. In this case, the BUYER may choose to cancel the order, request a replacement product, and/or extend the delivery period until the obstructive condition is resolved. If the BUYER cancels the order, the amount paid will be refunded to the BUYER's account within 10 business days according to the payment method.
If payment was made by credit card, the refund will be processed within seven business days. The BUYER acknowledges that any delay in reflecting the refund on their account after the refund is processed is subject to the bank's procedures, and the refund may take approximately 2-3 weeks to appear in the BUYER’s account.
4.11. For matters not addressed in this Agreement, the provisions of the Turkish Commercial Code, the Law on Consumer Protection, and the Regulation on Distance Contracts shall apply.
ARTICLE 5 - CONFIDENTIALITY COMMITMENT
Heyniri.co is committed to keeping personal information private, and no part of the data collected will be shared with third parties or used for any purpose beyond what is outlined in the Membership Agreement.
ARTICLE 6 - COMMERCIAL ELECTRONIC COMMUNICATION APPROVAL
The Member agrees to receive promotional and informational electronic communications from Heyniri.co. Members may unsubscribe anytime by clicking the link provided in these emails.
ARTICLE 7 - DEFAULT OF DEBTOR
In the event of default by the BUYER, the BUYER agrees to compensate the SELLER for any loss resulting from the delayed fulfilment.
ARTICLE 8 - COMPETENT COURT
For disputes arising from this contract, the Consumer Arbitration Committee or Consumer Courts in the BUYER's jurisdiction shall be competent.
